Service Contract for Assistant Professor (Contractual)

TERMS AND CONDITIONS OF SERVICE CONTRACT FOR THE TEACHERS   APPOINTED ON CONTRACTUAL BASIS (FIXED SALARY) IN VARIOUS DEPARTMENTS.

 

1.      Mr/Dr. …………………………………………. will work as Assistant Professor on Contractual Basis (Fixed Salary) at Department of ………........................... on the post against………………. for the Academic Session 20….-20…..     after signing this contract.

2.        The service of this contract Appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory "or terminable without assigning any reason with one month notice or one month’s salary in lieu of notice". Mr./Dr. ………………………..will be entitled to weekly holidays or gazetted holidays as well as the holidays declared by the A.M.U. Aligarh. If he absents from duty the Deduction will be made from the salary.

3.      The Appointee will be paid salary and allowances as specified in the appointment order. The timing of duty during the working days will be as per decision of Board of Studies issued by the Chairman and Dean Concerned of the A.M.U Aligarh from time to time.

4.      Mr./Dr ............................................ will report his duty in the Department within the time as given in the appointment letter. This contract is for one academic session only and not against any permanent post.

5.      The salary will be released only after the execution of the requisite bond between the Appointee and Registrar, Aligarh Muslim University, Aligarh.

6.      The Appointee shall be responsible for the accomplishment of the task/work load assigned to him/her by the Chairman & Dean or any other authority of the University.

7.      The contract of service of the contract employee during the period of contract may be terminated by the University at any time without assignment reason by 30 days’ notice in advance or in lieu of payment of one month's salary and vice versa.

8.      The Contract Appointee will be appointed as Assistant Professor on Contractual Basis for a period of one Academic Session on a fixed salary of Rs. ……………. Per month which will be reviewed as and when the gross salary of a regular appointed teacher is revised.

9.      Such appointment would be initially for not more than one Academic Session and the performance of any such entrant should be reviewed for academic performance before re-appointing her/him on contract basis for another session as per UGC Regulations, 2010.

10.       (a)      Contract Appointee will be entitled only for the following kind of leave admissible to the  teaching staff:-

(i)            Casual Leave of 8 days

(ii)          Special Casual Leave not exceeding 10 days in an Academic year at the discretion of the Vice-Chancellor.

(iii)         Earned Leave

(iv)         Detention Leave

(v)          Maternity Leave            According to Part B of Leave Regulations 1976.  

(vi)         Quarantine Leave

(vii)        Paternity Leave  

 

 (b)       Contract Appointee shall be entitled to pay for the following summer vacation only if he/she joined duty within 2 months of the beginning of the academic year and has worked continuously and satisfactory from the date of joining up to the last working day of the session.

 

(c)        If Contract Appointee continues for a part or whole of the next term and the teacher joins on the opening date and has also served on the last working date before the vacation in any one academic session, the vacation salary may be paid to him. 

 

(d)        Contract Appointee will also be entitled for MAS facilities as approved by the Executive Council at its meeting held on 31.07.2000.

11.        Unauthorized absence from the duty without the approval of the controlling authority shall lead to the termination of the contract. The Appointee will not be entitled for the payment of contractual amount for the period of absence from duty. If the contract appointee continuously remained absent for more than 8 days his service will be terminated automatically.

12.        For official tours, the Contract Appointee will be entitled to DA/TA at par with the regular incumbents assessed at the minimum of the regular pay scale for the post.

13.        The Contract Appointee will not be treated like regular teachers of the faculty for the purpose of voting rights for AMU Court, Executive Council and Academic Council election. Appointee under this contract will not be governed by Statutes, Ordinances relating to appointment of teachers appointed in the University in permanent or even temporary teachers but the appointee would be governed by the specific contract agreement for a given period, subject to termination without assigning reason during the period of contractual service. Mr./Dr. ……………………….will not be entitled to get any benefit which is extended to regular employee of the Department of A.M.U Aligarh.

14.        The Contract appointee shall devote his/her whole time to the service of the University and shall not without permission of the University, engage, directly, in any trade or business Whatsoever, or in any private service or any other work to which may emolument or honorarium is attached. However, this prohibition shall not apply to work undertaken with prior permission of the Competent Authority, in connection with the academic/research work and publication thereof.

15.        In addition to the specific teaching assignment, the Contract Appointee can be assigned any other duties by the Chairman & Dean concerned, any officers or authority of the University.

16.        The contract Appointee will have to give a declaration regarding his/her family details such as parents/spouse/children.

17.        The Contract Appointee shall serve faithfully and diligently; and shall not indulge in activities detrimental to the interest of the University.

18.        In case of any dispute/grievance arising out of this contract the same shall be referred to the Vice Chancellor of A.M.U. Aligarh and the decision of V.C or nominated officer shall be final and binding on both the parties.

19.        The Contract Appointee shall have no right or lien of any sort on the post he/she was working as specific contract Appointee in Aligarh Muslim University, Aligarh, after termination or expiry of this contract.

20.        The Contract Appointee shall not claim any benefit on account of any lien or entitlement from his/her parent department, if already employee elsewhere.

21.        As noted above, the appointee under specific contract will not be governed with terms & conditions or service relating to permanent or temporary teachers of university who are appointed in terms of Statutes and Ordinances or any regulation of the university. The appointee's appointment will solely governed by the specific contract for a particular period and that to determinable even without assigning any reason during contract period subject to one month notice or salary.
